Welmicron Pvt. Ltd., Baroda vs Assessee

Income Tax Appellate Tribunal10 April 2015

Ratio decidendi

The rule this decision rests on

The Tribunal dismissed the assessee's appeal in limine because the assessee did not appear and had failed to furnish a changed address, so that notice of hearing returned unserved; the dismissal rests on the principle that an appellant who does not prosecute its appeal may be dismissed without a decision on the merits.

PER SHRI KUL BHARAT, JUDICIAL MEMBER :

This appeal by the Assessee is directed against the order of the Ld.Commissioner of Income Tax(Appeals)-III, Baroda ('CIT(A)' in short) dated 24/12/2009 pertaining to Assessment Year (AY) 2004-05. The assessee has raised the following grounds of appeal:-

1. The Ld.Commissioner of Income Tax (Appeals)-III, Baroda has erred in law and in facts in confirming the action of Ld.AO in the ITA No.2419/Ahd/2011 Welmicron Pvt.Ltd. vs. ITO Asst.Year - 2004-05 -2-

issuance of notice u/s.148 of the I.T.Act after a lapse of four years from the end of the assessment year ignoring the following:

a) The assessment was originally completed u/s.143(3) on 16/11/2006.

b) In the assessment made, the Ld.A.O. had examined the reasons for the fall in G.P. and accepted the same.

c) The reason for reopening as recorded and furnished to the appellant also is on account of fall in G.P.

d) The issue of fall in G.P. being examined in the original assessment, the reopening for similar reason amounted to review of the same assessment arising out of change in opinion.

2. The impugned assessment dated 24/12/2009 being made u/s.143(3) r.w.s. 147 commenced on the basis of notice u/s.148 which itself being illegal is void ab initio deserving its cancellation.

3. The Ld.Commissioner of Income Tax (Appeals)-III, Baroda has erred in law and in facts in confirming the action of Ld.AO in making an addition of Rs.14,50,980/- on account of fall in gross profit margin. The impugned addition being in complete disregard of the available material and law is prayed to be deleted.

4. Your appellant craves liberty to add, alter, delete or substitute any of the ground(s) of appeal hereinabove contained.

2. No one has appeared from the side of appellant-assessee. Notice of hearing has been issued on 25/02/2015 fixing the date of hearing on 24/03/2015 as per address furnished in Form No.36, which was sent through Registered Post (A.D.) to the assessee (as per evidence on record

- RG 26683751 IN) and same is returned by the Postal Authorities with remarks "Not available". The assessee ought to have furnished the changed address. Under these circumstances, we have no option but to dismiss this appeal since the assessee is not interested in prosecuting its ITA No.2419/Ahd/2011 Welmicron Pvt.Ltd. vs. ITO Asst.Year - 2004-05 -3-

appeal. Therefore, in view of Hon'ble Madhya Pradesh High Court decision in the case of Estate of Late Tukojirao Holka vs. CWT (1997) 223 ITR 480 (M.P.) and of Hon'ble Delhi Tribunal decision in the case of CIT vs. Multiplan India (Pvt.) Ltd. 38 ITD 320 (Delhi), we dismiss the appeal of the assessee in limine.

3. In the result, the appeal of the Assessee is dismissed.

Order pronounced in the Court on Friday, the 10th day of April, 2015 at Ahmedabad.
