Vikram Bhawanishankar Sharma vs Icici Bank Limited
- CitationCompany Appeal (AT) (Insolvency) No. 342 of 2024
Ratio decidendi
The rule this decision rests on
The Tribunal's disposal rests on the following reasoning: where the appellant states that it is endeavouring to settle the dues of the financial creditors, the appropriate course is for the appellant to proceed under Section 12A of the Insolvency and Bankruptcy Code, 2016, through the Interim Resolution Professional, with any settlement application to be filed by the financial creditor and considered in accordance with Section 12A read with Regulation 30A of the CIRP Regulations, 2016. Because the appellant's pursuit of settlement is to be channelled through Section 12A, the Tribunal holds that there is no reason to keep the appeal pending, and disposes of it with liberty to the parties, subject to the interim protection continuing for a limited period, after which the proceedings are to follow the Adjudicating Authority's orders, with further steps to await disposal of any Section 12A application filed within that period.
