Tube Investments of India Limited (“TIIL”) — Combination C-2020/09/769
- Case No.C-2020/09/769
Ratio decidendi
The rule this decision rests on
A combination is approved under Section 31(1) of the Competition Act, 2002 where, having considered the material on record and the factors in Section 20(4), the Commission is of the opinion that the combination is not likely to have an appreciable adverse effect on competition in India. Vertical relationships between the parties, such as a supply interface between the acquirer's subsidiaries or associates and the target's products, do not by themselves preclude approval. Where the Commission finds that such relationships are not such as to cause an appreciable adverse effect on competition, the combination may be approved. An approval under Section 31(1) rests on the accuracy of the information furnished by the acquirer and stands revoked if that information is found to be incorrect.
