- CitationComp. App. (AT) (Ins) No. 662 of 2024
Ratio decidendi
The rule this decision rests on
Once the corporate insolvency resolution process has commenced against a corporate debtor, amounts payable to the corporate debtor, including government subsidy disbursements, must be paid into the corporate debtor's estate and disbursed in accordance with the resolution plan approved by the Committee of Creditors, and a direction issued by the Adjudicating Authority to pay such amounts directly to third-party government authorities on the basis of a pre-commencement letter from the erstwhile management cannot stand.
