The Nilgiri Dairy Farm Private Limited vs Mr. Sanjay Gupta

National Company Law Appellate Tribunal8 September 2025Ashok Bhushan

Ratio decidendi

The rule this decision rests on

The adjudicating authority was right to dismiss an application seeking rejection, as not maintainable, of a pending application under Section 43 of the Insolvency and Bankruptcy Code, where that challenge is itself to be decided on the merits in the pending application; and the dismissal of such an interlocutory application does not preclude the respondent from raising all objections and defences when the pending application is considered.
