The Commissioner Of Central Excise & ... vs M/S. Andra Ferro Alloys Ltd

Customs Excise and Service Tax Appellate Tribunal5 February 2015

Ratio decidendi

The rule this decision rests on

The operative part of an appellate order that is internally contradictory, in that its findings sustain the original order while its dispositive part allows the appeal and sets that order aside, is liable to be set aside, and the matter may be remanded to the appellate authority for fresh decision on the merits without any opinion being expressed on those merits.

HON'BLE SMT. ARCHANA WADHWA, JUDICIAL MEMBER

Final Order No. 20236 / 2015

Per : ARCHANA WADHWA

After rejecting the request for adjournment, I proceed to decide the appeal itself inasmuch as a short issue is involved. Accordingly, I have heard the learned DR.

2. For better appreciation of Commissioner (A)s order, the relevant portion of the same is being reproduced below.

In this case, the adjudicating authority has clearly shown reasons for the denial based on the usage and the appellant argues that though the usage was so, there were cases where credit on cement and steel was allowed though used for civil purposes. In this regard, the usage of cement and steel was to lay the foundations of the capital goods and to provide supporting structure technological structures the credit was not denied. In this case, the reasoning of the adjudicating authority prevails and hence I do not find any reason to disturb the order of the Original Authority.

In view of the above, I pass the following order.

ORDER

The appeal is allowed and the Order-in-Original set aside.

2.1 As it is clear from above, the Commissioner (A) in his finding portion of the order has agreed with the final decision of the adjudicating authority. However, in the order portion, he has written that the appeal is allowed and the order-in-original is set aside. This seems to be an inadvertent mistake on the part of the appellate authority. Inasmuch as the order is self-contradictory vis-`-vis the finding portion, I deem it fit to set aside the same and remand the matter to Commissioner (A) for fresh decision. I make it clear that no opinion on the merits of the case is being rendered and the appellate authority would decide the matter in accordance with the law declared by the higher appellate forums. Revenues appeal is thus allowed by way of remand.

(Order pronounced and dictated in open court)
