Tajit Kumar Saha, Kolkata vs Assessee
- CitationAppeal No. 343/CIT(A)-XXXVI /Kol/ITO,Wd-55(3)/Kol./2011 -12 dated 30.09.2 014 f
Ratio decidendi
The rule this decision rests on
Where an assessee carries on business from commercial premises taken on a genuine leave and licence agreement, and the agreement has not been shown to be false, the rent paid for those premises is an allowable business expenditure, and the Assessing Officer cannot disallow it merely because the premises could not be physically located at the time of verification or because the assessee's other income did not require such expenses.
