Suratram vs State Of U.P.

Allahabad High Court7 May 2026

Ratio decidendi

The rule this decision rests on

Where an accused is charged with offences under Sections 191(2), 191(3), 190, 115(2) and 103(1) of the Bharatiya Nyaya Sanhita, consideration of the nature of the offence, the evidence against the accused, the degree of the accused's complicity, the problem of overcrowded jails, and the heavy pendency of criminal cases before trial courts may together constitute grounds sufficient to grant bail during the pendency of trial, applying the principles laid down in Kapil Wadhawan vs Central Bureau of Investigation and the guidelines in Maya Tiwari vs State of U.P. An applicant released on bail shall furnish a personal bond and two sureties in an amount to be determined by the court, and any breach of the conditions imposed shall be grounds for cancellation of bail. The trial court must verify the identity, status and residence of both the applicant and the sureties before accepting the bonds. The trial court must verify the mobile number and Aadhaar card details of the applicant and the sureties. An applicant may be released on the basis of a computer-generated copy of the bail order downloaded from the official website of the High Court, provided the counsel verifies it and undertakes to file the certified copy within fifteen days. The trial court shall transmit the release order to the jail through the Bail Order Management System to facilitate the early release of the applicant.
