Sultan vs State Of U.P. Thru. Prin. Secy. Home Lko.

Allahabad High Court7 May 2026

Ratio decidendi

The rule this decision rests on

Where an accused is charged under the Narcotic Drugs and Psychotropic Substances Act and prima facie satisfies the twin conditions under Section 37 of that Act, bail may be granted where the recovered contraband is below commercial quantity, the accused has been in custody for a significant period, possesses no previous criminal history, and the circumstances otherwise warrant it as a fit case for bail. Observations made in a bail order are confined to the question of bail and shall have no bearing on the merits of the trial.
