State Bank Of India vs Commissioner Of Central Excise, ...
- CitationAppeal No. 10/2014
Ratio decidendi
The rule this decision rests on
Where a first-appellate authority remands a matter to the original adjudicating authority for fresh quantification, it has no need to direct that penalty, interest and adjustment of excess payment are not to be considered again; those questions are properly left to the original authority when it re-quantifies, and a direction foreclosing them is set aside.

Final Order No. 20301 / 2015
Per: B.S.V. MURTHY
After hearing both the sides, we find that the appeal has been filed only on the ground that the Commissioner (Appeals) while remanding the matter should not have given directions about penalty and interest and non-adjustment of excess payment. Therefore we consider that the appeal itself can be decided at this stage itself and accordingly the requirement of pre-deposit is waived and appeal is taken up for disposal. Having remanded the matter to the original adjudicating authority, there was no need for the Commissioner to give a direction that penalty and interest and adjustment of excess payment need not be considered again. In our opinion under the circumstances it would have been appropriate to leave the decision about penalty, interest and adjustment of excess payment also to the original authority when re-quantification exercise is taken up. Therefore we set aside the impugned order as regards the above observations are concerned and direct the original adjudicating authority to consider all the issues afresh and pass a well reasoned order in accordance with law.
