Soumitra Basu, Kolkata vs Assessee
- CitationAppeal No. 959/CIT(A)-XXXVI /Kol/ITO,Wd-55(2)/Kol/2009-10 dated 28.08 .2014 for
Ratio decidendi
The rule this decision rests on
Interest paid on a personal loan taken by a medical practitioner to reconstruct and equip his chamber and to develop his clinic, and on a loan used to purchase a vehicle needed to visit clients and attend patients at hospitals, is an allowable business expenditure where the loan was admittedly taken for the purposes of the assessee's business, and the assessing officer's disallowance on the ground that the loan related to a self-occupied house property cannot be sustained.
