Smt. Surinder Kaur, Kanpur vs Assessee

Income Tax Appellate Tribunal21 April 2015

Ratio decidendi

The rule this decision rests on

The penalty under section 271(1)(c) cannot be determined while the quantum proceedings on which it depends remain unresolved; where the quantum issue has not attained finality, the penalty issue is premature and the matter is to be restored to the first appellate authority for fresh decision in the quantum proceedings, with an opportunity of hearing to both sides, before the penalty can be decided.

ORDER

PER A. K. GARODIA, A.M.

This is assessee's appeal directed against the order of Learned CIT (A) - I Kanpur Dated 04.03.2013 for A.Y. 2005 - 2006.

2. The only grievance of the revenue is regarding penalty of Rs. 5,00,000/- imposed by the A.O. u/s 271 (1) (c).

3. Learned A.R. of the assessee submitted that in quantum proceedings, the tribunal has set aside the orders of the authorities below and restored the matter to the file of the learned CIT (A) for fresh decision. He also submitted the tribunal order in ITA No. 213/l/2009 dated 19.01.2010 is available on pages 19 to 30 of the paper book. He drawn our attention to Para 6 of the tribunal order. Learned DR of the Revenue supported the Penalty order.

We, therefore, restore the matter back to learned CIT (A) for fresh decision after passing fresh order in quantum proceedings as directed by the tribunal. Needless to say, he should provide adequate opportunity of being heard to both sides.
