Smt. Sabita A. Biswas vs Shri Vinodkumar Pukhraj Amnavat Rp R.K ...
- CitationCompany Appeal (AT) (Insolvency) No. 1056 of 2022
Ratio decidendi
The rule this decision rests on
The Adjudicating Authority's view that an unregistered and unstamped sale deed, executed before a Notary, cannot be relied upon as the basis for a claim to purchase of immovable property is correct; such an instrument cannot be the foundation of a claim to acquire title to immovable property in insolvency proceedings, and the Appellate Tribunal finds no error in rejecting the claim on that basis.
