Shri Bhavesh Pabari vs Sebi

Securities Appellate Tribunal14 March 2016J.P. Devadhar

Ratio decidendi

The rule this decision rests on

The Tribunal condones a 65-day delay in filing the appeal on the strength of the reasons stated in the misc. application, without the text setting out those reasons. The appeal is permitted to be withdrawn in light of the Supreme Court's decision in SEBI v. Roofit Industries Ltd., and on that basis the Tribunal grants the appellant three months to pay the penalty imposed by the impugned order, with SEBI accepting payment in full discharge of the claim and, on default, being free to recover the penalty with interest as permissible in law.
