Shivam @ Shivan vs State Of U.P. And 3 Others

Allahabad High Court7 May 2026Krishan Pahal

Ratio decidendi

The rule this decision rests on

Where an accused is granted bail during the pendency of trial in a case involving serious offences, the court may impose conditions including: (1) furnishing personal bond and sureties; (2) refraining from tampering with evidence; and (3) personal presence before the Trial Court at specified stages of the proceedings, with deliberate or unjustified absence being treated as abuse of bail liberty subject to cancellation proceedings. Observations made by the bail-granting court in its reasoning shall not constrain or influence the trial judge's independent assessment of witness testimony and the merits of the case.
