Shakambari Consultants & Builders vs Deegee Infracon Private Limited & Ors

National Company Law Appellate Tribunal14 September 2022

Ratio decidendi

The rule this decision rests on

The Supreme Court's suo motu order dated 10.01.2022 in M.A. No. 665 of 2021 (in Suo Motu W.P. (C) No. 3 of 2020) excluded the period from 15.03.2020 to 28.02.2022 from computation of limitation for all judicial or quasi-judicial proceedings, and an appeal filed within that extended period is therefore not barred by limitation and the delay is condoned on that basis.
