Sama Srinivasa Reddy, Hyderabad vs Assessee
- CitationITA No. 1312/Hyd/2014
Ratio decidendi
The rule this decision rests on
The Tribunal, in deciding an application for stay of recovery of tax demand pending appeal, will not grant an absolute stay where the assessee's prima facie case and the balance of convenience do not justify it, and may instead grant a conditional stay tied to payment of a part of the outstanding demand, with the stay to lapse automatically on default and the balance to remain stayed for a fixed period or until disposal of the appeal, whichever is earlier.
