Salman vs State Of U.P. Thru. Prin. Secy. Home Lko.

Allahabad High Court6 May 2026

Ratio decidendi

The rule this decision rests on

In a bail application under sections 459 I.P.C and 3/25 Arms Act, the court may grant bail by considering the facts and circumstances of the case, the applicant's criminal history, the nature of the alleged offence, the period of custody already undergone, and the arguments of counsel, without thereby expressing any opinion on the merits of the trial. Observations made in a bail order regarding the grant of bail are confined to the bail application alone and shall have no bearing on the merit of the trial. A court granting bail may impose such conditions as it deems fit and proper in the circumstances of the case, in addition to the standard requirements of personal bond and sureties.
