Rushabh Precision Bearings Limited vs Shimnit India Private Limited

National Company Law Appellate Tribunal16 September 2022Ashok Bhushan

Ratio decidendi

The rule this decision rests on

The ratio of this order rests on the Tribunal's view that initiating contempt proceedings is not warranted where a party, having given an undertaking to deposit a sum to secure an interim benefit, failed to deposit it and the underlying appeal was thereafter dismissed on merits, such that the party was never entitled to the benefit of the interim order; the failure to deposit in those circumstances does not, on the facts, constitute a contempt justifying initiation of proceedings.
