Rupnarayanpur Samabay Krisi Unnayan ... vs Assessee

Income Tax Appellate Tribunal24 February 2015

Ratio decidendi

The rule this decision rests on

The interest earned by a cooperative society on surplus funds placed in short-term deposits with public sector banks, where those banks are not members of the society and the funds were not required for the society's business of providing credit to its members, is not attributable to the society's operational activities and so is not eligible for deduction under section 80P(2)(a)(i) of the Income Tax Act. Such interest is therefore liable to be assessed, and an enhancement of the assessment on that footing is sustainable.
