Richa Gupta & Ors vs Hotel Zodiac Pvt Ltd & Ors

National Company Law Appellate Tribunal5 July 2021

Ratio decidendi

The rule this decision rests on

The period of limitation for an appeal under section 421 of the Companies Act, 2013, runs for 45 days from the date on which a copy of the Tribunal's order is made available to the person aggrieved; where the copy date is not disclosed, the period is computed from the date of the impugned order. Where the limitation period expired between 15.03.2020 and 14.03.2021, the extension directed by the Supreme Court in suo motu Writ Petition No. 3 of 2020 gives the appellant a further period of 90 days from 15.03.2021 within which to file the appeal, and an appeal filed within that extended period is within limitation, so no question of condonation of delay arises.
