Revocation Order in the matter of Transgene Biotek Ltd.

Securities And Exchange Board Of India6 November 2018

Ratio decidendi

The rule this decision rests on

Where an investigation launched under an interim ex parte order finds no adverse evidence of violation of the SEBI Act or the PFUTP Regulations against particular entities, the directions issued against those entities under Sections 11, 11(4) and 11B are liable to be revoked, because their continuation is no longer warranted. Revocation is confined to the entities in respect of whom no adverse findings are made. Directions against other entities against whom violations are observed continue, and the revocation is without prejudice to any further action the Board may take under law.
