Resolution Professional Of Venta ... vs Present

National Company Law Appellate Tribunal25 June 2021

Ratio decidendi

The rule this decision rests on

The period during which the Committee of Creditors was restrained from approving a resolution plan by an interim order of the Appellate Tribunal, and the period during which the corporate insolvency resolution process was affected by a lockdown, are to be excluded when computing the 270-day timeline under the Insolvency and Bankruptcy Code framework, where the restraint or disruption is shown to have operated and the exclusion is claimed on that basis.
