Rekha Bhandari vs Sebi

Securities Appellate Tribunal12 January 2018J.P. Devadhar

Ratio decidendi

The rule this decision rests on

The impugned ex parte ad interim order was passed without issuing a show cause notice and without affording the appellant an opportunity of hearing, and such an order cannot stand against the appellant; it is therefore quashed as against her, with SEBI directed to pass a fresh order after hearing her, the ex parte order being treated as a show cause notice.
