Ravendra Pal Singh vs State Of U.P.
- Neutral2026:AHC:103373
Ratio decidendi
The rule this decision rests on
In a bail application under Section 302 IPC, where the court considers the nature of the offence, the evidence against the accused, the degree of his complicity, the overcrowded state of jails, and the heavy pendency of criminal cases before trial courts, the accused may be granted bail on personal bond with sureties, notwithstanding the severity of the charge, without prejudice to the merits of the case. Where bail is granted, breach of the conditions imposed shall be grounds for cancellation of bail. The trial court must verify the identity, status, and residence of the applicant and sureties before accepting bonds, and must verify the mobile number and Aadhaar card details of the applicant and sureties. A bail order issued by the High Court in the form of a computer-generated copy downloaded from its official website and verified by the concerned counsel, with an undertaking to file the certified copy within fifteen days, is a valid basis for the release of an accused from custody. The trial court shall transmit the release order to the concerned jail through the Bail Order Management System to ensure expedited release of the applicant.
