Allahabad High Court6 May 2026

Ratio decidendi

The rule this decision rests on

An applicant in custody charged with offences under the Bharatiya Nyaya Sanhita (B.N.S.) may be released on bail where: (i) the applicant has been in custody for a substantial period; (ii) the applicant has no previous criminal history; and (iii) identically situated co-accused persons have already been granted bail by the same court, without prejudice to the merits of the case. The trial court may impose such additional conditions on bail as it deems fit and proper in the circumstances of the case. Observations made in a bail order are confined to the bail application and do not constitute any opinion on, or prejudge, the merits of the trial.
