Allahabad High Court6 May 2026Rohit Ranjan Agarwal

Ratio decidendi

The rule this decision rests on

Where a contempt application alleges willful disobedience of a court order, and prima facie evidence of non-compliance is established, the court shall not proceed immediately to punishment but shall first issue a formal notice to the contemnor through registered post via court office with a self-addressed envelope for compliance, allowing the opposite party a specified period to comply with the original order before considering contempt proceedings.
