Polowings Healthtech Private Limited vs Jayanta Kumar Mittal

National Company Law Appellate Tribunal3 December 2025

Ratio decidendi

The rule this decision rests on

The Appellate Tribunal sets aside an order passed in the absence of a party who had been unable to attend, and directs that the party be afforded a further opportunity of hearing before the Tribunal below, the decision on the merits to be taken thereafter; the reasoning rests on the fact that the matter was reserved for orders after hearing only the opposing party when the appellant was absent, and the appeal is disposed of on that footing, with the appellant made to bear costs and bound by an undertaking against adjournment.
