Platinum Owl C 2018 RSC Limited — Combination C-2022/06/945
- Case No.C-2022/06/945
Ratio decidendi
The rule this decision rests on
Where the Commission finds, on the material before it and having assessed the factors in Section 20(4), that a proposed combination is not likely to cause an appreciable adverse effect on competition in India in any relevant market, it may approve the combination under Section 31(1) of the Act. The Commission need not settle the precise delineation of the relevant market where it is satisfied that the combination is not likely to cause an appreciable adverse effect on competition in any of the candidate markets. Where the combined market shares of the parties in all segments and sub-segments are low and the incremental market share is insignificant, the combination is not likely to cause an appreciable adverse effect on competition, and approval may follow. An approval so granted remains liable to revocation if the information furnished by the notifying parties is later found to be incorrect.
