Piyush Tewari vs Kashi Vishwanathan Sivaraman

National Company Law Appellate Tribunal24 January 2024

Ratio decidendi

The rule this decision rests on

A Tribunal dismissing an application must give reasons for its decision; an order that disposes of an application by a bare statement that the court is not inclined to grant the prayer, without any reasoning, is non-speaking and is contrary to the principles of natural justice, and is liable to be set aside on that ground.
