Parvinder Singh Khurana vs Kamal Agarwal & Ors

National Company Law Appellate Tribunal3 October 2023Ashok Bhushan

Ratio decidendi

The rule this decision rests on

The Appellate Tribunal will not entertain, in an appeal against an adjudicating authority's order, documents that were not placed before the adjudicating authority; a party cannot rely on such material for the first time in appeal. Where a party has been afforded repeated opportunities by the adjudicating authority to file its reply and synopsis and has failed to avail them, it is not entitled to indulgence on appeal, and the appeal against the adverse order is dismissed.
