Paramount Coaching Centre Private ... vs Romesh Chandra Grover

National Company Law Appellate Tribunal13 September 2023Ashok Bhushan

Ratio decidendi

The rule this decision rests on

Where an adjudicating authority has already heard the parties on the main petition in part, and the application seeking to place an additional affidavit on record is pending, the interests of justice are served by directing that the additional affidavit be taken on record, so that further delay in the final disposal of the main proceedings is avoided, and without expressing any opinion on the merits of that affidavit, which remains for the adjudicating authority to consider when deciding the main petition.
