Pappu @ Shahid vs State Of U.P.

Allahabad High Court6 May 2026

Ratio decidendi

The rule this decision rests on

An accused person charged with offences under Sections 191(2), 191(3), 115(2), 352, 351(3), 117(2), 190, 118(1), 109(1), and 103(1) BNS may be granted bail during the pendency of trial where, considering the nature of the offence, the evidence against the accused, the degree of complicity, the state of prison overcrowding, and the heavy pendency of criminal cases before trial courts, the court forms the opinion that bail is warranted, without expressing any opinion on the merits of the case. Where bail is granted, the accused shall be released on furnishing a personal bond and two sureties in like amount, and breach of the conditions imposed on the bail shall constitute grounds for cancellation of the bail. The court concerned shall verify the identity, status, and residence of the applicant and sureties before accepting the bonds, and shall also verify the mobile number and Aadhaar card details of both the applicant and sureties. A computer-generated copy of the bail order downloaded from the official website of the High Court and verified by the concerned counsel, with an undertaking that a certified copy will be filed within fifteen days, shall be a sufficient basis for release of the applicant without awaiting the formal certified copy. The trial court shall transmit the release order to the concerned jail through the Bail Order Management System to ensure expeditious release of the applicant.
