Securities And Exchange Board Of India19 July 2021

Ratio decidendi

The rule this decision rests on

Where the Appellate Tribunal has directed, as an interim measure, that a sum be deposited, the regulator may permit a frozen demat account to be defrozen solely for the purpose of selling specified securities to raise that sum. The defreezing extends only to the sale, the crediting of its proceeds to a designated bank account, and the transfer of those proceeds to the regulator's account, and the directions under the original order otherwise remain in force.
