Order in the matter of Summary Proceedings against the Stock Brokers who defaulted in Payment of Registration Fees

Securities And Exchange Board Of India25 June 2010

Ratio decidendi

The rule this decision rests on

The payment of the outstanding registration fees, as required by Schedule III of the SEBI (Stock Brokers and Sub-Brokers) Regulations, 1992, after initiation of summary proceedings for non-payment, means that cancellation of registration is not warranted. Where the enquiry regulations under which summary proceedings were initiated have been repealed and replaced by the SEBI (Intermediaries) Regulations, 2008, the pending proceedings may be disposed of under Regulation 33B(5) and (6) of the 2008 Regulations, read with section 19 of the SEBI Act, 1992, without further directions, the respondents being advised only to pay fees as required in future.
