Order in the matter of Godavari Biorefineries Ltd

Securities And Exchange Board Of India7 August 2017

Ratio decidendi

The rule this decision rests on

Where the noticees have, on the documents they furnish, complied with directions issued under Sections 11 and 11B of the SEBI Act, 1992, the Board may revoke those directions under Section 19 read with Sections 11 and 11B. Compliance is established on the material before the Board, including the chartered accountant's certificate of refund calculations and payments, the registrar and transfer agent's reports, the auditor's report and balance sheet showing dissolution of the trust, and proof of publication of the public notice. Revocation is conditional on the accuracy of that material. If the information, declarations or certificates furnished in support of compliance are later found to be untrue or factually incorrect, the Board remains free to take appropriate action against the noticees under the relevant provisions of law.
