Order in the matter of Eltrol Ltd

Securities And Exchange Board Of India28 July 2010

Ratio decidendi

The rule this decision rests on

Where an investigation under the SEBI Act is complete and final or adjudicatory action has been taken or initiated against the persons named in an ad interim ex-parte direction, the Board may hold that the interim directions need not continue against them, and may revoke them under Section 19 read with Sections 11, 11B and 11(4). Revocation of interim directions on that basis does not decide the merits of any pending adjudication. Pending adjudication proceedings continue before the Adjudicating Officer under the SEBI Act and the Adjudication Rules, and must be decided on their merits, uninfluenced by the revocation order.

WTM/PS/27/IVD/ID-4/JULY/2010 BEFORE THE SECURITIES AND EXCHANGE BOARD OF INDIA CORAM: PRASHANT SARAN, WHOLE TIME MEMBER IN THE MATTER OF ELTROL LTD. ORDER Under Sections 11B, 11D and 11(4) of Securities and Exchange Board of India Act, 1992 1. Securities and Exchange Board of India (hereinafter referred to as ‘SEBI’), upon noticing sudden variation in price and volume in the shares of Eltrol Ltd. (hereinafter referred to as ‘Eltrol’) presently known as Shree Mahaganga Sugar Mills Ltd. conducted a preliminary examination of the dealings in the scrip. The preliminary examination revealed that the price of the scrip of Eltrol (having face value Re.1) at Bombay Stock Exchange Ltd.
