Notice given by L & T Technology Services Limited and Dell International Services India Private Limited — Combination C-2014/08/203
- Case No.C-2014/08/203
Ratio decidendi
The rule this decision rests on
The Commission may approve a combination under section 31(1) of the Competition Act, 2002 where, on the notice given under section 6(2) and having assessed the factors listed in section 20(4), it is of the opinion that the combination is not likely to have an appreciable adverse effect on competition in India. Applying that test to these facts, the Commission holds that a combination is unlikely to have such an effect where the acquirer's share in the relevant engineering services market is below 10 percent, the target's share is insignificant, the parties have no existing vertical relationship, and the market contains other significant competitors with larger shares. An approval so granted stands revoked if, at any time, the information furnished by the parties is found to be incorrect. The approval is also without prejudice to any other legal or statutory obligations applicable to the parties.
