Notice given by Daido Steel Co. Ltd. — Combination C-2014/08/199

Competition Commission Of India27 August 2014

Ratio decidendi

The rule this decision rests on

Where the notified acquisition of a minority equity stake yields only insignificant horizontal overlap and vertical relationships between the parties, and their market shares are insignificant when measured against the total market value of the relevant industry, the combination is not likely to have an appreciable adverse effect on competition in India, having regard to the factors in section 20(4) of the Act. On that assessment, the Commission may approve a combination under section 31(1) of the Act, and such approval is granted without prejudice to other statutory obligations and stands revoked if the information furnished by the acquirer is found to be incorrect.
