Nitya Nand Thakur vs Kgk Realty (India) Private Limited

National Company Law Appellate Tribunal9 April 2024Ashok Bhushan

Ratio decidendi

The rule this decision rests on

The Tribunal's power under the proviso to Section 61(2) of the Insolvency and Bankruptcy Code, 2016 to condone a delay in filing an appeal is confined to a further period of fifteen days beyond the prescribed limitation period; where the delay exceeds the period that can be condoned under that proviso, the Tribunal has no jurisdiction to condone it, and the delay condonation application and the appeal itself must be rejected.

Appeal. Order impugned was passed on 24.04.2023 and the Appeal was e-

filed on 19.01.2024.

in which the application of delay condonation was rejected.

3. The present case is fully covered by Judgment in `Sumit Singh
