Nitin Hasmuklal Parikh vs Idbi Bank Ltd

National Company Law Appellate Tribunal5 January 2018

Ratio decidendi

The rule this decision rests on

The Adjudicating Authority, when considering an application to extend the Corporate Insolvency Resolution Process beyond the 180-day period, is to have regard to the Committee of Creditors' resolution seeking more time and to the need to afford the Committee an opportunity to obtain the best resolution plan; where those considerations are present, the extension sought may be granted in the Tribunal's discretion, and the Appellate Tribunal may modify an order that has granted less time than warranted for that purpose.
