Nirahu Alias Suleman vs State Of U.P. And 3 Others
- Neutral2026:AHC:107848
Ratio decidendi
The rule this decision rests on
Where the principal prosecution witness has turned hostile during trial and resiled from earlier statements, an accused person makes out a case for bail during the pendency of trial, assessed without prejudice to the trial court's independent assessment of the evidence on its merits. Bail granted on personal bond and sureties is conditioned on the accused not tampering with evidence, not intimidating witnesses, and appearing as required; breach of these conditions is grounds for cancellation of bail. Observations made by an appellate court in granting bail do not bind or influence the trial court's independent formation of opinion based on witness testimony at trial.
