Naxpar Pharma Private Limited vs Sanjai Kumar Gupta

National Company Law Appellate Tribunal18 July 2022

Ratio decidendi

The rule this decision rests on

The Tribunal condoned a delay in re-filing a memorandum of appeal after office defects were cured, holding that the reasons given in the interlocutory application (the authorised representative's residence in Kolkata, the company's base in Mumbai, and the time taken to circulate the papers for signature and physical filing through local counsel in Delhi) were sufficient cause, so that the period of delay could be condoned and the appeal listed for admission as a fresh case.
