Nalin Virji Shah vs G G Photo Limited And Anr
- CitationCompany Appeal (AT) (Insolvency) No.873 of 2023
Ratio decidendi
The rule this decision rests on
The Appellate Tribunal's disposal of this application rests on the principle that, where the claimant seeks payment of professional fees and CIRP expenses from a party whose dues are not settled by agreement, the applicant may pursue the balance of the claim by filing an appropriate application before the Adjudicating Authority, and the Appellate Tribunal will not itself adjudicate that claim in the present proceedings.

Settlement having reached between the parties, we are of the view that the CIRP be closed and need not proceed any further. Order dated 20.06.2023 is set aside. is in accordance with the IBBI circular.
4. Learned counsel for the Respondent submits that the Respondent have
already paid Rs.11 Lakhs to the IRP and Respondents are still in discussion
with the IRP to pay some more amount.
