Mr. Sanjay Chamria, Kolkata, West Bengal — Combination C-2023/03/1015
- Case No.C-2023/03/1015
Ratio decidendi
The rule this decision rests on
The Commission may leave the exact delineation of the relevant market open where it finds that the combination is not likely to cause an appreciable adverse effect on competition in any of the possible alternative markets. Where the acquirer's share in the relevant upstream and downstream markets is insignificant or minuscule, and the market contains other players that will continue to constrain the parties after the combination, the Commission may conclude that the combination is not likely to cause an appreciable adverse effect on competition. A combination is approved under Section 31(1) of the Competition Act, 2002, where, having considered the material on record and the factors in Section 20(4), the Commission is of the opinion that it is not likely to have any appreciable adverse effect on competition in India in any relevant market. An approval granted on the basis of information furnished by the parties remains liable to revocation if that information is later found to be incorrect.
