Mr. Gaurav Gupta vs Sebi

Securities Appellate Tribunal31 January 2017J.P. Devadhar

Ratio decidendi

The rule this decision rests on

The appeals are disposed of by remitting the matter to the regulator without examining the merits, because the appellants' challenge to the confirmatory order is belated and the appeals are inordinately delayed; the Tribunal directs SEBI to reconsider the case and pass a fresh order after affording the appellants a personal hearing.

CORAM : Justice J.P. Devadhar, Presiding Officer Dr. C.K.G. Nair, Member

Per : Justice J.P. Devadhar (Oral)

1.

In all these appeals, the appellants have challenged the confirmatory order

passed by the Whole Time Member of the Securities and Exchange Board of India

('SEBI' for short) on February 17, 2016 with Miscellaneous Application seeking

condonation of the delay. By the said confirmatory order, the directions contained in 4

the ex-parte ad-interim order dated June 29, 2015 have been confirmed solely on the

ground that the appellants have failed to file their objections.

2. In view of the fact that there is inordinate delay in filing these appeals and in

view of the fact that the appellants though belatedly are objecting to the continuation

of the ex-parte ad-interim order, without going into the merits of the case, we dispose

of these appeals by directing SEBI to consider the case of the appellant and pass an

order after affording an opportunity of personal hearing to the appellants.

3. All the appeals as also the Miscellaneous Applications are disposed of

accordingly with no order as to costs.
