- Neutral2026:AHC:105908
Ratio decidendi
The rule this decision rests on
Where a spouse files a petition under Section 528 B.N.S.S. to quash proceedings under Section 498-A I.P.C. and the Dowry Prohibition Act, the court may dismiss the petition as to the accused spouse where specific allegations are made against him, but must examine whether a co-accused who is the mother-in-law has been levelled only general and omnibus allegations without particulars, and if so, may quash the proceedings as to that co-accused.

11. Per contra, learned counsel for the opposite party no.2 and learned counsel for the State opposed the prayer for quashing and submitted that the applicant no.1 is the husband and the applicant no.2 is the mother-in-law of the opposite party no.2 and they are named in the first information report. Two other co-accused named in the first information report have been exonerated during investigation.
