Mohd Amir vs State Of U.P. And 3 Others

Allahabad High Court7 May 2026Krishan Pahal

Ratio decidendi

The rule this decision rests on

Where a case involves allegations under the POCSO Act and the statement of the alleged victim prima facie indicates her consent, as evidenced by her voluntary accompaniment with the accused and subsequent marriage, and the ossification test report places the victim's age within a margin of error that could place her above the age of majority, and there is an absence of medical evidence to corroborate the alleged incident, the court may grant bail to the accused during the pendency of trial on the basis that a prima facie case for bail has been made out.
