Mobile Telecommunications Ltd., ... vs Assessee

Income Tax Appellate Tribunal5 June 2015

Ratio decidendi

The rule this decision rests on

The Tribunal may dismiss an appeal in limine, without hearing on merits, where notice of the hearing sent by registered post with acknowledgement due to the assessee has been returned unserved as "unclaimed" and the assessee has furnished no change of address, the Tribunal inferring from these circumstances that the assessee is not interested in pursuing the appeal. Where an appeal has been dismissed in limine on this footing, the assessee may apply to the Tribunal for restoration of the appeal, and the Tribunal may recall its order and restore the appeal to its original number for hearing on merits if the assessee shows reasonable cause for non-appearance on the date of hearing.
