Mobeen vs State Of U.P.

Allahabad High Court7 May 2026

Ratio decidendi

The rule this decision rests on

Where an accused is charged under the Narcotic Drugs and Psychotropic Substances Act and applies for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the court may grant bail having regard to the totality of facts, the nature of the evidence on record, and the provisions of Section 37 of the N.D.P.S. Act, applying the principles established in cases dealing with bail in drug offences. Breach of conditions imposed in a bail order constitutes grounds for cancellation of that bail. An order granting or refusing bail in interlocutory proceedings expresses no opinion on the merits of the case, and the trial court remains free to arrive at its independent conclusions on the basis of evidence led, unaffected by anything stated in the bail order.
